Litigation, in which a judge makes the final decisions as to division of property, child custody, child support, and alimony (as may be applicable) is most often not the best way to resolve a divorce case. If a settlement of some or all of these issues can be achieved outside of court, this is much preferable. For example, should both parties be open to some amount of compromise, divorce mediation is often a better answer.

At Montgomery Family Law, we are open to using the mediation process to work toward a negotiated settlement. It is important to understand that, in the vast majority of cases, the mediation process involves both parties hiring his or her own attorney, then selecting an independent mediator that is experienced in family law to help facilitate a mediated resolution. If you wish for our Certified Superior Court Mediator, Charles H. Montgomery, to act as your mediator, he cannot also provide legal advice to either party (this is the responsibility of each party’s own independent attorney). Where Charles H. Montgomery acts as mediator, the parties will each need to retain their own attorneys.
Divorce mediation has some myths associated with it. For example, people are often under the mistaken impression that the mediation process can take longer than litigation. This is most often false. Information gathering tends to be less cumbersome through the mediation process because it is done in a collaborative manner, rather than according to the mandates of the court. This facilitates the settlement process and typically shortens the timeline to eventual resolution. A faster divorce can help protect you from undue stress and save legal fees.
The notion that women are at a disadvantage in divorce mediation is another common fallacy. In fact, either party is free to refuse to sign a mediated agreement that is not equitable, effectively bringing the mediation process to a halt until the other party presents an acceptable settlement proposal.
Divorce mediation is often a preferable alternative to traditional litigation. Should you want to stay on good terms with your spouse (and you should, because most often this is better for both parties in the end), this can be particularly true. Best of all, divorce mediation means you have more control over the divorce process.
